This is because the Cloud Bread case is also a very unusual case, and if the government s standard contract is used in the long run, unfair contract practices in the publishing industry can be almost eradicated. In other words, the necessity of the existence of this legislation is still necessary to coordinate unfair contractual relations that exist in Korea s various fields of culture. In relation to the standard contract , both the government and the publishing industry have progressed more than before. Specifically, in the case of standard contracts in the publishing industry, the right to create secondary works, which was previously only set as a special agreement, was included in detail along with the sub-right so that the artist could be familiar with the related contents at the time of signing the contract. However, there are also some important problems, such as a long period of 10 years at the time of the initial contract of the publishing right (exclusive publishing right), and an easy design to delegate the right to create secondary works to publishers. On the other hand, the government s standard contract contains desirable contents in terms of protecting the right holder, such as withholding the right to create secondary works to the creator and placing an obligation to notify the creator when a third party requests a third party.
