Korean Civil Law regulates the obligee s right of revocation by article 406 and 407; however, there are controversies over the effect of this exercise. The effect is not specified in the civil law but the court chose the ¡°relative invalid¡± theory, and this theory became the case law and the common opinion. However, this is not always accomplished in all cases, and there are judgements in which it does not coordinate with the relative invalid theory. Especially after the obligee s litigation for revocation, there are not any standards in the Civil Execution Act about processing properties, thus a big gap exists between the law and theory and practice. This study analyzed Japanese civil law s enactment purpose which was the controversy s root, and the reason of this theory of analysis.
Article 406 and 407 of Korean civil law was accepted from article 424 and 425 of Japanese civil law without any long discussions. Although this regulation was originally legislated by Gustave Boissonade, a French jurist, referring to the French civil law, he accepted not the common opinion nor the precedent, which is the right user s priority, but the minority s opinion, the creditor s equality principle. And to solve this problem, he tried to enact debtors to intervene in litigations, but it wasn t regulated. In contrary, the relative invalid theory was chosen by an old trial and established through common opinion and precedent.
There is not a harmony between the Korean precedent s relative invalid theory and article 407 of Korean civil law. Moreover, this enactment was made when the Bankruptcy Law did not exist and a substantial law and adjective law were not organized. Therefore, this problem cannot help being solved by amending the Civil Code, while considering the match with the Civil Execution Act.
