본 글은 2018년 6월 13일에 치러질 전국지방선거와 교육감선거에서 선거권행사를제한 받고 있는 ‘19세 미만’의 청소년의 선거권 보장을 위해 관련 정치관계법의 개정이시급히 진행되어야 함을 촉구하기 위하여 작성되었다. 특히 대의제 민주주의의 한계를보완하기 위해 도입된 지방자치는 국민이며 주민인 주권자의 의사를 정치적 의사결정과정에 직접 투영할 수 있는 제도이다. 따라서 현재 유예된 주권자로 대우받고 있는 ‘19 세 미만’의 청소년에게도 자신이 속한 지방의 정치적 의사 결정과정에의 참여가 보장되어야 한다. 그럼에도 불구하고 공직선거법 제15조, 주민투표법5조, 지방교육자치에 관한 법률 제49조에서는 선거권연령을 ‘19세 이상’의 자에게만 부여함으로써 ‘19세 미만’ 의 청소년의 지역공동체 구성원으로서의 주권행사를 제한한다. 이와 관련하여 입법부인 국회와 헌법재판소는 ‘19세’의 선거권연령의 설정을 입법형성권 재량의 영역이며, 정치적 판단능력의 존재여부, 교육적 부작용 등을 논거로 제시하여 정당화하고 있다.
그러므로 제시된 논거들이 ‘19세 미만’의 청소년의 선거권을 제한할 수 있는 정당한 논거인지를 판단하고, 더불어 ‘19세 미만’의 청소년의 지역자치참여의 근거를 헌법규정을통해서 확인하였다. 또 외국의 지방선거권연령의 하향의 움직임과 그 과정에서 논의되었던 정당화 논거를 참고하여 현재 공직선거법 상 규정된 지방선거권연령이 시대적 흐름에 부합되는지 여부를 판단하였다. 이와 같은 판단을 통해서, 현재의 지방선거권연령을 규정하고 있는 정치관계법들은 특히 지방선거에 ‘19세 미만’의 청소년들이 참여할수 있도록 공직선거법 제15조 제2항, 주민투표법 제5조, 지방교육자치에 관한 법률 제49조는 입법개선이 조속히 진행될 필요가 있음을 인식하였다. 따라서 동 규정 등을 개정 입법할 시에는 현행 규정과 같이 일괄적으로 공직선거법 제15조 제1항의 선거권연령을 적용할 것이 아니라, 각 선거의 목적에 맞게 18세, 16세 이하의 선거권연령을 개별 입법화할 필요가 있다는 것을 결론으로 제시하였다.

Therefore, it was judged whether the proposed argument was a legitimate argument to restrict the right of the youth of ‘under the age of 19’, and the legal basis of local self - government participation of the youth of ‘under 19’ was confirmed through constitution.
In addition, I will refer to the downward movement of the age of the election age of foreign countries and the justification argument discussed in the process. On the basis of this, it was judged whether or not the age of the election right prescribed in the current Public Election Law meets the trend of the times.
Through this judgment, the political relations laws, which define the current age of electoral rights, recognize that legislative improvements need to be made at an early stage. In particular, Article 15 of the Public Official Election Act, Article 5 of the Local Voting Act and Article 49 of the Local Education Autonomy Act recognize that legislative improvement needs to be carried out at an early stage so that young people under the age of 19 can participate in local elections.
In conclusion, therefore, when amending the related laws, it is not necessary to apply the voting age of Article 15, Paragraph 1 of the Public Official Election Act collectively as in the current regulations. For the purpose of each election, it is necessary to legislate separately the age of election age of 18 years old and 16 years old.
