The Filial Ethics tradition that is made research in the history of thoughts and legal culture has new existing value these days. We are confronted with the risk society, which is so to speak lack of confidence, selfishness, unfairness and corruption etc,. The purpose of this paper is to study the essential contents and social application of the filial ethics during the premodern China(to Qing-dynasty) and Korea(to Joseon- dynasty), considering that Korean society claims to reform the present social risk. Also in the aspect of the history of legal culture, the filial ethics of the Chinese Confucian idea had become the core value of legislative and judicial systems and constituted the significant letters of the statute in the traditional Chinese and Korean codification. These legal culture played a crucial role in the construction of social order and development of humanity which shows respect for all man¡¯s life and dignity. Above all the premodern Korea(to Joseon dynasty) accepted the elements of these Confucian legal thoughts and followed his own way to set up the legal system of Joseon dynasty. The filial ethics had the triple meanings as follows ¨çalways benefiting kindred ¨è serving ancestors with devotion ¨éprudently attending the elders¡¯ funeral ceremony and performing a religious service. Supposing we study all we can on this filial ethics, we are to overcome these risk state of affairs in Korea which are widespread nowadays. The filial ethics will give us an answer that brings the risk society to amicable settlement. Finally I expect that certain relevant issues would be studied for separate papers such as the problem of aging society, the concrete practice of filial ethics and moral education.
