이 연구는 사립학교법의 제정과 개정과정에서 사립학교의 자주성과 공공성이 어떻게 반영되어 왔는지에 대한 탐색을 통하여 자주성과 공공성, 어떤 측면이 강조되어 왔는지를 분석하고자 하는 목적으로 수행되었다.
개정 시기별 주요 개정의 주요 내용에 대한 분석결과는 ①｢법제정기｣(1961년∼1993)에서는 사립학교에 대한 공익적 가치를 우선시하는 공공성 강화에 중점을 두었으며, ②｢자주성 신장기｣(1993-1997)에서는 학교법인 이사 수에 대한 규제를 완화하는 대신에 전문성 증진을 통한 이사회 자주성 신장과 더불어 사립학교 운영의 공공성과 투명성을 높이기 위하여 학교법인 회계에 대하여 외부 감사제도 도입하는 법 개정을 하였으며, ③ ｢자주성과 공공성 갈등기｣(1998-현재)에서는 진보진영과 보수진영의 갈등에도 불구하고 사립학교의 족벌운영 체제 개선을 위한 대학평의회 설치 및 개방이사제도 도입의 법개정이 있었고, 등록금을 기본으로 하는 교비회계, 법인회계. 기금회계 등을 명확하게 구분하는 법 개정이 있었고, 관할청의 징계요구를 면탈하는 사립학교와 학교법인에 대한 지도·감독권 강화하기 위한 법 개정이 있었다.
사립학교법 개정의 주요 특징은 ① 사립학교법의 제정과 개정은 일부 사학의 비리와 부조리가 여전히 재현되는 실정에서 자주성 보다는 공공성 강화를 주요목적으로 하고 있으며, ② 사립학교법 개정의 주요 쟁점은 학교법인의 거버넌스의 개선, 교원의 신분보장, 재정 운영의 투명성 확보, 관할청의 지도·감독권, 기타 사립학교 운영 및 제도개선 등이며, ④ 자주성과 공공성의 갈등이 심각하게 표출되었던 사립학교법 개정은 대학평의회와 학교운영위원회의 도입, 개방이사 도입관련 개정이었으며, ⑤ 진보진영은 지속적으로 사학운영주체인 이사회의 거버넌스에 관심을 자진 반면에 보수진영은 사학재정의 투명성 확보에 상대적으로 많은 관심을 보인 것으로 분석되었다.

The main findings of the study, which analyzed the revision of the Private School Law in terms of ensuring the independence of private schools and strengthening public character, are as follows.
First, in the Lawmaking Period (1961-1993), it can be seen that the government has continuously strengthened its public character of prioritizing open values for private schools.
Second, in the period of Extended Self-reliance (1993-1997), instead of easing regulations on the number of directors of school corporations, the Private School Law on the Introduction of an External Audit System for the Accounting of School Firms was amended to enhance the independence of the Board of Directors through the enhancement of professionalism and to increase the public nature and transparency of the operation of private schools.
Third, in the period of the conflict between self-reliance and public nature (1998-currently), under the progressive administration there was a revision of the law to establish a university council and introduce an open board system to improve the nepotistic management system of private schools despite conflicts between progressive and conservative camps, whereas under the conservative administration there was a revision of the law that clearly classified school expenses, corporate and fund accounts based on tuition.
The Moon s government also revised the law to reinforce the supervisory authority for both private schools and educational foundations, which avoid disciplinary action from the competent authority.
The overall trend over the past 60 years has gradually reduced the government s authority to supervise and supervise, and on the contrary, it is steadily increasing the autonomy of the school corporation, the main body of the establishment and operation of private schools.
