청탁금지법(2016.9.28.) 시행 이후, 청탁금지법의 해외버전으로 알려지고 있는 글로벌 윤리규범의 하나인 ISO 37001(2016)을 국가기술표준원에서 국가표준(KS) 작업(2017.11.14.) 을 하였는데, 우리나라 기업들도 글로벌 수준의 뇌물방지경영시스템 적용 가이드라인을 참고할 수 있는 국내 법규범이 생겼다는 점에서 의미가 있다. IS0 37001의 특징은 PDCA 모델에 따라 요구사항과 권고사항을 기술하고 있어, 이를 충실히 이행하였다면 효과적인 뇌물방지 컴플라이언스 시스템을 운영하고 있다고 인정받을 수 있다. ISO 37001이 KS 되기 이전부터 국내에서는 ISO 37001 인증 비즈니스가 이루어지고 있는데, 현재 부실 인증 리스크가 우려되고 있는 상황이다. 이에 본 연구는 ISO 37001의 관련내용을 검토하고, 인증관련 비즈니스의 비윤리적 관행과 감독당국이 챙겨야 할 점 등을 검토한다.

After enforcing the Improper Solicitation and Graft Act, the National Technology Standards Agency standardized ISO 37001(2016), one of the Business Ethics of Global Standard, Harmonizing International Standards into Korean Industrial Standards (KS). (Nov 14, 2017) It is meaningful for corporations in Korea that we have localized regulation that applies to global standard anti-bribery management systems. The characteristics of IS0 37001 is that it delineates the demands postulated and recommendations based on PDCA Model. PDCA Model of ABMS approach can be generic and can influence the way other systems or processes within an organization are developed. ISO 37001 can be integrated with other related PDCA-based management systems. In the event of a criminal investigation, approval to ISO 37001 will enable the organization to demonstrate that the organization has taken the responsible steps to prevent bribery. Even before the standardization by KS, many Certification Bodies have been dealing with ISO 37001 Certification Business, which is currently concerned with Improper Certification Risk. So, This essay will examine ISO 37001 and ISO 37001 Certification Risk.
