백지어음은 어음요건의 일부를 구비하지 않고 후에 보충시킬 의사로 발행된 미완성어음으로써 실무에서 경제적인 필요상 자주 이용되고 있다. 최근 백지어음에 의한 어음금청구의 소에 시효중단의 효력을 인정한 대법원 판결(대판 2010.5.20, 2009다48312)이 나왔으며, 이는 종래 백지어음에 의한 시효중단의 효력을 부정한 대법원 판결(대판 1962.12.20, 62다680)을 전원합의체판결로 변경한 것이다.
본 논문은 이 대법원 판결이 다루고 있는 백지어음의 백지보충권의 성질, 행사기간, 백지어음에 의한 시효중단의 효력 인정 여부에 관련된 종래의 우리나라 및 일본의 판례를 분석하였고, 나아가 이에 관한 학설을 검토함으로써 위 대법원 판
결이 가지는 의미를 검토한 것이다.
위 대법원 판결은 백지어음에 의한 소제기에 시효중단의 효력을 인정한 판결로써 종래의 대법원 판결의 혼란스러운 입장을 명확하게 정리하였다는 점에 의미가 있는 판결이다. 다만, 이 판결은 시효중단의 효력을 인정하는 논거의 하나
인 어음상 권리를 재판상 청구하는 경우에도 어음의 제시를 요하는가의 문제에 관하여 어음의 제시가 불필요하다는 논거를 명확히 언급하고 있지 않다. 또한 종래 판례들은 백지어음에 의한 소제기에 시효중단의 효력을 인정하면서 변론종결
시까지 백지를 보충하는 것을 전제로 그 효력을 인정해 왔으나, 위 대법원 판결은 이러한 전제조건 없이 백지어음에 의한 소제기에 시효중단의 효력을 인정하였다는 점에서 의미가 있는 판결이라고 평가된다.
또한 백지보충권의 행사기간과 관련하여 학설은 이를 제척기간 내지 행사기간의 문제로 설명하고 있는데 반하여 대법원 판례에서는 이를 소멸시효의 문제로 다루어 오고 있었는 바, 대상판결에서 이 부분에 대한 명확한 언급이 없다는 점이 아쉬운 점으로 남는다.

A blank bill is one drawn, indorsed, or accepted in blank. In other words, A blank bill is an incomplete instrument which is issued by the drawer without complement of requirements for a bill relating to the sum of money, the maturity, the name of a payee, the place of payment. A drawer give an authority to fill up those requirements of a bill
to the payee or the holder of a bill.
This paper deals with the Korean Supreme Court case decided in May 20th, 2010 which is a judgment on the blank bill issued without completing the requirements on the name of a payee, the place of payment. The main issue of this case is that a suit by the holder of a blank bill have the effect of the suspension of extinctive prescription of the
cause of action of the bill holder. There are several precedent cases of the Korean Supreme Court which is the same effect under the condition that the holder exercises the authority to complete the blank requirement of the bill before the closing argument in the trial court.
But the Supreme Court case of May 20th, 2010 agreed the effect of the suspension of the extinctive prescription by lawsuit of the holder without any condition.
So this paper reviewed the details of the case comparing with several precedent cases and many Korean scholars’ opinions on this issues of blank bill.
