Traditionally, only nations have had the right to participate in the creation and implementation of international law. This model led to non-transparent international negotiations and institutions managed behind closed doors. However, in the past decade, civil society and some governments have begun to demand more transparency and wider participation in international affairs.
As a result, a number of intergovernmental organizations, international financial institutions and trade regimes are gradually moving toward more open and participatory governance. This is the same in the area of international policy making. Relating to above situations, amicus briefs were addressed in the WTO. A fundamental characteristic of the WTO s dispute settlement system is that it is limited to claims brought by governments against other governments. So it is controversial that amicus briefs can affect dispute settlement in litigation government to government.
Currently, it is controversial among the WTO members whether WTO panels and Appellate Body claim the discretionary authority to accept and consider amicus briefs. This paper examines the notion of amicus brief, and current status of amicus brief in the WTO dispute settlement procedure by discussing the WTO cases, especially Shrimp/Turtle case and EC-Asbestos case.
