It is hardly possible to discuss social matters without labor issues, looking back over human history or foreseeing the future of mankind. Labor issues have been considered to be a matter of all time. And, a state has tried to eliminate practical problems by every conceivable legal and political means. Then it is both legally and socio-politically critical to interpret the contents of the Constitution: with regard to the issue of labor, how the Constitution guarantee fundamental human rights based on what values and ideology.
Right to work and the three basic labor rights are provided as one of the fundamental human rights in Article 32 and 33 of the Constitution. Various problems related to the labor issues have been tried to be solved based on the Constitution, as a legal criteria. However, Article 32 and 33 are not clear enough to give concrete criteria so that they are sometimes used as ground for two contrary arguments or used as different means from different perspectives. In current globalized world, based on neo-liberalism, these theoretical and practical debates agitate overall comprehension of right to work and the three basic labor rights. Moreover, it is a harsh reality that the social status of laborer, the subjects of right to work, has been daunted or insecure.
This reality we face serves a momentum to guarantee the rights in not only domestically but also internationally complicated regulation system. Therefore, this thesis focuses on discussing normative meaning of the Constitution aiming at guaranteeing that the laborers¡¯ rights are interpreted and applied, at least, as fundamental rights guaranteed by the Constitution to form the foundation of satisfying basic human needs.
