The 9¤ý11 terrorist attacks have forever changed the concept of traditional terrorism due to its unprecedented scale and means and thereby led the debate on what is permissible in situation of state exigency. Terrorism inevitably brings devastating consequences for the human rights costs as well as for governmental functions. Just as terrorism influences on a range of fundamental human rights, so too can measures adopted by States to counter terrorism. However, in the absence of international agreement on the definition of terrorism, it remains difficult to distinguish lawful from unlawful violence at the international level.
While a state is endowed with a duty to effectively prevent the terrorism, it is also confronted with a duty to protect and respect the human rights at the same time. Derogation clauses, found in many international and regional human rights treaties, can be invoked to safeguard the right of a state in dealing with public emergencies. For instance, derogation clauses included in the International Convention on Civil and Political Right allow a state to be exempt from the duty to protect human rights from extraordinary threats, yet these clauses contain a number of strict criteria regarding the extent to which the temporary exemption is tolerable.
The UN has been continuously expressing its concern about human rights particulary in the context of terrorism and investigating the human rights dimensions of terrorism by generating a series of resolutions, working papers and reports. As terrorism and counter-terrorism measures clearly fall under the mandate of UN human right bodies as well as various human rights treaty bodies, it should be reminded that human rights are the utmost value to be upheld even in the fight against terrorism.
