신문사나 방송사, 잡지사 등 언론기관은 국민의 알권리에 조직적·효과적으로 봉사하는 기관이라는 점에서 언론사의 보도의 자유는 국민의 알권리와 표리관계에 있으며, 국민의 알권리의 대상이 되는 것은 정보가치가 있는 모든 표현물이다. 그러나 언론사의 매체활동과정에서 빚어지는 음란물에 대한 책임은 누가, 어떻게, 어떤 기준에 따라 부담해야 하는지, 그리고 어떤 경우에 환전한 항변(complete defence)으로서 면책이 되는지, 정당화 할 수 있는 목적(justifiable ends)은 존재하는지에 관한 문제가 우리나라에서 법학논문으로서 다루어진 예는 거의 찾아보기 어렵다. 단지 문학이나 예술작품으로서의 영화, 연극 등의 표현방법과 표현기법을 둘러싼 음란성 판정만이 주된 논점이었을 뿐이다.
  물론 음란물과 관련된 법리는 표현매체가 무엇이든 이러한 성에 관한 표현의 결과물을 일컫는 성표현물(Sexual Representation, sexual expression)의 개념과 그 규제정도, 방법 등에 대해서는 개인이나 사회, 국가의 개별적인 입장차이가 분명히 존재하기 때문에 시대와 사회의 문화적인 흐름에 따라 찬반논쟁은 일정하지 않다. 따라서 법의 다른 어떤 분야보다도 성표현물에 대해서는 각국이 처해있는 정치·경제·사회·문화·역사·종교적 배경에 따라 그 규제의 범위와 한계가 현저히 다르다. 외형적인 삶은 물론, 전반적인 사고방식까지 서구화된 우리나라의 경우에도 성에 대해서만은 아직도 유교적·가부장적·권위주의적 체제가 개인과 사회를 지배하고 있고, 입법과 판례 또한 이같은 경향이 그대로 반영되어 있다. 우리나라에서 성표현물과 관련한 판례가 대거 등장한 시점이 주로 1990년대 이후의 일이라는 점에서도 알 수 있듯이, 1988년을 전후하여 ‘性은 공개되지 않아야 한다’는 유교사상에서 벗어나 ‘성도 公論의 대상이어야 한다"는 성담론에 관한 논쟁이 일었던 時點과궤를 같이 하고 있다.
  본고는 신문에 게재되는 만화를 중심으로 언론사가 그 음란성에 대하여 어느 정도 책임을 져야 하는지, 과연 책임을 질 수 있는지, 책임을 져야 한다면 어떤 법리에 따라 정당화될 수 있는지, 하는 헌법학적 문제를 우리나라에서 있었던 신문만화사건을 중심으로 다룬다.

  This paper deals with concerns about public and private morality, about market morality and commercial honesty, about national control on the sexual representation on the basis of constitutional theory specially in the part of comic strip in news papers. Government concern with morality stretches far beyond the question of obscenity. Governments have sought for many centuries to protect the citizenry, expressly children, from exposure to events or reports, so much as comic strips that might threaten the desired social fabric. For example after 1990"s, government enacted several laws(The Minor Protection Law, Juvenile Protection Law, Sex Offense Prevention Law etc.) to prevent social morality from all type of detailed representation of sexual conduct, and arrested 8 members of the editorial staffs from major news papers and 13 cartoonist.
  The Korean Supreme Court ruled not guilty and the Korean Constitutional Court declared these laws unconstitutional, but government that pursue efforts to limit the presence of obscene activities in their communities, may take advantage of such other techniques as abating public nuisances. So it remains the legal theory how and in some measure, sexual representation through comic strip would protect as a constitu tional freedom. In this thesis I"d like to establish "sex and obscenity are not synonymous, that is, sex, a great and mysterious motive force in human life, has indisputably been a subject of absorbing interest to mankind via the ages" through related legislation and cases analysis. Moreover the comic strips have to protect as a freedom of expression on the constitutional law.
