최근 논란이 되고 있는 이혼숙려기간의 제도화와 관련하여 이혼숙려제도의 발생배경과 기능을 고찰하고, 이미 이혼숙려제도를 실시하고 있는 다른 나라의 사례에 비추어 현재 발의되어 있는 법(안)의 목적 및 운영체계, 선택권과 절차 등의 문제를 비교 논의함으로써 시사점을 탐구하는데 본 연구의 목적이 있다. 영국과 독일의 사례를 중심으로 비교 논의한 내용을 요약하면, 우리나라에서 현재 논의 중인 이혼숙려 및 이혼전상담의 목적은 이혼예방에 주안점을 두지만, 다른 나라의 경우는 이혼절차에서 비롯되는 고통을 최소화하는데 목적을 두고 있다는 점에서 차이점이 있다. 또 이혼숙려 및 상담에 대해서는 이혼을 신청하는 부부에게 강제하는 방식과 선택사항으로 두어야 한다는 입장으로 구분할 수 있으며, 법원의 역할에서는 법원의 상담자 연계 및 관리 역할과 자체적인 조직을 두고 상담 및 교육을 실시해야 한다는 입장으로 구분되는 차이점이 있었다. 이와 같은 쟁점 및 이견은 무엇보다 현사회의 결혼 혹은 이혼에 대한 인식과 이혼이 증가하는 현실간 격차가 큰 반면, 이런 차이점에 대한 충분한 논의 과정이 불충분하였고, 제도의 사회문화적 적합성에 대한 우려가 팽배한 것과 관련이 있다. 따라서 제도화 이전에 우리 사회의 이혼현상에 대한 사회문화적 해석과 연구가 측적될 필요가 있다.

  The purpose of this study is to examine the institutionalization of careful deliberation period for divorce and pre-divorce counselling and to analysis the relevant issues. Concretely, the aims of institutionalization, the systems of management, the rights of divorcees and the procedures of institutionalization are discussed with references to cases of western countries" divorce polices. As a results at the primary stage, the aims of careful deliberation period focus on the prevention of divorce, but recently it has a tendency to emphasize on the best interest of children and the minimalization of divorcees" social and psychological stress. And in terms of the rights of the divorced person, the opportunities to participate in divorce counselling and parent education are afforded to the divorcees. Finally, in Korea, the direction of institutionalization tends toward to give information the counsellors and agencies, but other countries" courts have a tendency to manage directly the various programs for the divorces and their children. Besides of these differences, the negative perception of the divorcees, the processes and procedures of institutionalization of careful deliberation period and the social and institutional fitness are discussed. In conclusion, I argue it is necessary to accumulate the researches and interpretations about divorce phenomenon in korean society.
