우리나라 대학은 학문연구와 교육의 장으로서의 기능하고 있으나 그 양적인 성장에도 불구하고 만족스러운 교육서비스가 제공되지는 못하고 있다. 그리고 이러한 질적인 성장을 뒷받침하기 위해서는 많은 비용투입이 요구되지만 현재 사립대학이 겪고 있는 재정난과 취약한 재정적 구조는 이를 감당하기 어려운 것이 현실이다.
이러한 상황에서 주요 사립대학을 중심으로 재정난을 개선하고 교육의 질적 향상을 위한 방안으로 주장되고 있는 것이 기여우대입학제이며, 이는 대학에 대한 물질적 또는 비물질적 기여자에게 그에 상응한 우대를 하는 것으로서 특히 이를 대학이 가지는 학생선발권과 연계시키는 것이다. 하지만 이는 개인의 학업능력이 아닌 직계존속의 기여를 이유로 입학시 우대하는 것이라는 이유로 헌법상 평등권과 교육을 받음 권리를 침해한다고 비판되어 왔다.
하지만 기여자의 기여부분에 상응하여 기여우대입학제를 시행하는 경우에도 그 직계후손에게 일정한 학력수준을 요구하고 이를 정원외 특별전형의 방식으로 제한된 인원을 선발한다면 이를 다른 학생들의 평등권과 교육을 받을 권리를 직접적으로 침해 한다고 보기는 어렵다. 또한 대학이 가지는 학생선발과 재정에 대한 자치를 고려할 때 입학시 기여부분을 고려하고 재정의 확충을 위한 한 방안으로서 제한적으로 합리적 절차와 방법에 의한 기여우대입학제를 시행하는 것은 일정부분 허용된다고 하겠다. 다만 이 경우에도 기여금은 그 사용목적이 연구와 교육을 위해서만 사용되어야 하며, 그 집행과 관리도 투명하고 공정하게 이루어져야 한다.
이처럼 기여우대입학제는 헌법적 허용범위 내에서 합리적으로 운영되고 그 기여금이 공정하게 집행될 경우 대학의 재정확충과 교육의 질적 개선을 위한 수단으로 기능할 수 있으나 그렇지 않고 학업능력이 갖추어지지 않은 학생에게 금전적 대가를 이유로 입학시 특혜를 주는 식으로 변칙적으로 운영될 경우 이는 대학의 질과 그 명성 자체를 저하시키는 결과를 가져올 수 있다. 따라서 대학 스스로 그 자치의 범위 내에서도 그 제도형성과 운영과 관련해서는 특별히 신중한 고려를 필요로 한다고 하겠다.

Besides, considering the university autonomous of finances, this system is allowed to be carried out by restricted and fair procedures and measures In order to secure a variety of financial resources. Of course, the donations must be spent only for study and education, the execution and management of them also carried out transparently and justly.
With a right standard and impartial enforcement, the contribution enrollment system can be a good way to improve the quality of education owing to the expansion of finance through it. 30n the contrary, if the system is operated the way to give a preferential treatment In return for the money to students with below standard for admission of scholastic performance, it will result in the degradation of the quality and reputation of the university or college.
